Unit D and E

EARLY RETIREMENT BENEFIT FOR UNIT D AND E EMPLOYEES

An early retirement law passed the Legislature in July 2003. It is a one-time opportunity for eligible Unit D & E employees (not teachers). A city, can choose to accept the law. IF a municipality accepts the law, it must do so no later than November 1, 2003.
The employee application deadline is December 2, 2003. Employees who qualify for this benefit must retire no later than December 31, 2003.
The law allows eligible employees to be credited with up to an additional five (5) years of age, or five (5) years of service or a combination of additional years of age and service not to exceed five (5) years. The governing authority may limit the total amount of additional credit offered for age and service to less than five years.
The governing authority may limit the number of employees to whom the benefit is offered. If participation is so limited, employees with greater years of service must be approved before employees with lesser years of service.
To be eligible for the benefit, employees must be at least 55 years of age.
The retirement benefit cannot exceed 80 percent of an employee’s average annual rate of regular compensation.
Payment due for accrued vacation time and unused sick leave is to be negotiated in accordance with Chapter 150E.
